Whistle Blowing

What is whistle blowing?

This is disclosing information that a worker believes is evidence of illegality, gross waste, gross mismanagement, abuse of power or substantial and specific danger to the public health and safety. 

In order to receive the protection offered by statute on whistle blowing, the following criteria must be followed:

  • The disclosure must be a qualifying disclosure

  • It is made with a reasonable belief in its truth

  • It has been made to an appropriate person

Qualifying Disclosures

To be protected the whistleblower needs to reasonably believe that the malpractice is happening, has happened or will happen. 

The malpractice can take the form of:

  • A criminal offence

  • Risk or actual damage to the environment

  • Employer engaging in unsafe work practices es
