– Identify/explain the conflict of interest 
– Threats to objectivity and confidentiality created
– Safeguard of disclosure to both parties 
– Other safeguards (½ mark each), e.g. separate teams, confidentiality agreements, review of situation
by independent partner
– If threats too significant the advice should not be given
