Accurate knowledge of the legal principles involved linked to a sound application of those principles. It is highly unlikely that marks at this level could be achieved without reference to the cases, although it is possible nonetheless.
5–7 marks
Sound knowledge of the law but perhaps lacking in application or alternatively not showing a sufficiently clear understanding of the legal principles involved.
2–4 marks
Weak or unbalanced answer. Perhaps aware of the nature of the problem but lacking in clear knowledge of the law or deficient in relation to how those principles should be applied.
0–1 mark
Very weak answer demonstrating little if any knowledge of the topic.
